3. User Accounts and Registration

To use our Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring you have the authority to bind your organization to these Terms

4. Subscription Plans and Payment

  • Growth Plan: $199/month - 200 posts, 5 platforms, advanced features
  • Agency Plan: $499/month - Unlimited posts, all platforms, enterprise features

Payment Terms

  • Subscription fees are billed monthly in advance
  • All fees are non-refundable except as specified in our refund policy
  • We offer a 30-day money-back guarantee for new subscribers
  • Prices may change with 30 days’ notice to existing subscribers

5. Acceptable Use Policy

You agree not to use our Service to:

  • Create content that is illegal, harmful, or violates third-party rights
  • Generate spam, misleading, or deceptive content
  • Promote hate speech, discrimination, or violence
  • Infringe on intellectual property rights
  • Attempt to reverse engineer or interfere with our AI systems

6. Content and Intellectual Property

AI-Generated Content

You own the content generated by our AI based on your inputs and brand training. However, you are responsible for ensuring all published content complies with applicable laws and platform policies.

Our Intellectual Property

Scale66’s technology, software, AI models, and platform remain our exclusive property. You may not copy, modify, or reverse engineer our systems.

7. Service Availability and Performance

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may suspend service for maintenance, updates, or to address technical issues. We are not liable for:

  • Temporary service interruptions
  • Third-party platform changes that affect posting capabilities
  • Content that fails to post due to platform restrictions
  • AI-generated content that doesn’t meet your expectations

8. Cancellation and Termination

Your Right to Cancel

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.

Our Right to Terminate

We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or if your account remains delinquent for more than 30 days.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Our liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold Scale66 harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Disputes

These Terms are governed by the laws of California, USA. Any disputes will be resolved through binding arbitration in San Francisco, California, except for claims of intellectual property infringement.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use constitutes acceptance of modified Terms.
